Cannabis Laws in Virginia

Is weed legal in Virginia? Yes — recreational and medical cannabis are both legal here for adults 21+.

Virginia legalized adult possession and home cultivation in 2021, allowing adults 21+ to possess up to one ounce and grow up to four plants per household. However, the state has never opened a legal adult-use retail market, so the only licensed stores are medical dispensaries. There is no legal way for non-patients to buy cannabis.

Federally, cannabis is still a controlled substance nationwide — but that status is in flux. See where rescheduling stands →
