Cannabis Laws in Delaware

Is weed legal in Delaware? Yes — recreational and medical cannabis are both legal here for adults 21+.

Delaware legalized adult use in 2023, and licensed adult-use retail sales finally began on August 1, 2025, initially through converted medical compassion centers. Adults 21+ may possess up to one ounce of cannabis, but home cultivation remains illegal. A medical program has operated since 2011.

Federally, cannabis is still a controlled substance nationwide — but that status is in flux. See where rescheduling stands →
