Cannabis Laws in South Dakota
Is weed legal in South Dakota? Medical only — cannabis is legal for registered medical patients, but not for general adult use.
South Dakota allows medical cannabis for registered patients (Measure 26, 2020), who may possess up to 3 oz and grow up to 4 plants in an enclosed, locked space. Dispensaries are open to cardholders with qualifying conditions. Recreational legalization passed in 2020 but was struck down by the courts, and later adult-use measures have failed.
Federally, cannabis is still a controlled substance nationwide — but that status is in flux. See where rescheduling stands →
