Cannabis Laws in New York

Is weed legal in New York? Yes — recreational and medical cannabis are both legal here for adults 21+.

New York legalized adult-use cannabis in 2021, and after a slow rollout, hundreds of licensed dispensaries are now open to adults 21+. Possession is allowed up to 3 ounces of flower and 24 grams of concentrate. Adult-use home cultivation is authorized by statute (6 plants per adult); check current OCM rules before growing.

Federally, cannabis is still a controlled substance nationwide — but that status is in flux. See where rescheduling stands →
