Cannabis Laws in New Mexico

Is weed legal in New Mexico? Yes — recreational and medical cannabis are both legal here for adults 21+.

New Mexico legalized adult-use cannabis in 2021, with licensed recreational retail sales beginning April 1, 2022 alongside its longstanding medical program. Adults 21+ can possess up to 2 ounces of flower, 16 grams of concentrate, and 800 milligrams of edibles in public, and may grow up to six mature plants per person (twelve per household).

Federally, cannabis is still a controlled substance nationwide — but that status is in flux. See where rescheduling stands →
