Cannabis Laws in Texas

Is weed legal in Texas? Largely no — this state has only a limited or CBD-restricted program, or no legal cannabis market.

Texas allows only a very restrictive, low-THC medical program through the Compassionate Use Program; there is no broad medical or adult-use legalization. HB 46 (effective September 2025) expanded the program by adding qualifying conditions and more product forms (smoking still banned). The state continues to wrestle with separate hemp-derived THC regulation.
